Everything Matters

Following Massachusetts v. EPA, climate-related disputes are increasingly finding their way into court, subjecting more businesses to potential liability for greenhouse gas contributions. DLA Piper can help clients settle climate disputes through litigation resolving government authority to regulate greenhouse gas emissions, determining the applicability of climate regulations to individual entities and defending client interests in tort actions alleging liability for prior emissions.

Our experience includes the following representative client matters:

  • Representing a multinational energy company in a lawsuit by an environmental group opposing an air permit for an oil sands project for lack of CO2 controls
  • Representing developers litigating whether the California Environmental Quality Act (CEQA) requires state or local agencies to consider the climate change impacts of proposed development
  • Successfully litigating the adequacy of a large commercial developer’s climate change impact analysis under CEQA
