The differences between international, domestic and regional carbon markets are becoming more complicated. Fortunately, we are well versed in navigating this increasingly complex field. Our lawyers have purchased, sold and negotiated contracts for emissions credits from the Kyoto Mechanisms (i.e. CERs, ERUs, AAUs, tCERs, lCERs, or RMUs) and independent Voluntary Emissions Reduction programs. By securing quantifiable, verifiable and actual emissions offsets, we provide our clients ample security behind their emissions reduction investments. We also advise our clients on the purchase, sale or trading of emissions credits under state and regional trading programs.
Our experience includes the following representative matters:
- Drafting contracts and negotiating with carbon credit brokers to design and construct a methane recovery system for a meat processing plant
- Advising clients on futures contracts for emissions credits and on the listing of renewable energy futures
- Drafting an exclusive agency agreement on behalf of a nonprofit organization, which the government of the Democratic Republic of the Congo appointed as its exclusive agent for creating and marketing all avoided-deforestation carbon credits from a reserve the size of Belgium
- Negotiating Voluntary Emission Reduction Purchase Agreements for carbon credits generated from energy-efficiency, afforestation and reforestation projects
- Advising clients on an application for emissions credit certification under the Clean Development Mechanism
- Structuring purchase agreements for clean energy emissions credits under the Regional Greenhouse Gas Initiative
- Advising on sales of emission reduction credits in voluntary carbon markets
