The Supreme Court’s decision in Massachusetts v. EPA, legislative activity in Congress and the states, and EPA’s endangerment finding have all but guaranteed that climate change regulation in the United States will become a reality, likely impacting all sectors of the economy. This prospect has profound implications for business, government, our future sources of energy and our lives.

Our Experience
At DLA Piper, we have substantial experience addressing our client’s climate related needs across a variety of projects, sectors, and institutions. Our experience includes the following representative matters:

  • We provide advocacy, counseling and transactional support to help clients navigate the EU Emissions Trading Scheme, Kyoto Protocol requirements, voluntary carbon markets and federal and state initiatives in the US.
  • We advise clients and negotiate transactions for carbon credits through Clean Development Mechanism and Joint Implementation projects and voluntary carbon markets.
  • We also work closely with our clients to develop strategic climate plans, identify carbon burden, risks and opportunities and prepare companies for integration into a carbon-constrained world.
  • Recognizing that greenhouse gas regulation will require new energy needs and sources, we represent clients on a range of advanced technology matters, from carbon capture and storage to renewable energy generation, and successfully obtain project financing to meet the needs of a global energy infrastructure.
